CSLB Workers' Comp Suspension: How to Get Your License Back
Updated November 1, 2026
CSLB says workers' comp coverage must be continuous, and a lapse suspends the license. Work done during the suspension is considered unlicensed. CSLB lifts the suspension once acceptable proof is received and processed. Which proof depends on what happened.
Which document clears it
| What happened | What CSLB needs | Who sends it |
|---|---|---|
| Insurer cancelled your policy | Reinstatement notice rescinding the cancellation | Insurer |
| Policy expired | Renewal notice | Insurer |
| New policy | Certificate of Workers' Compensation Insurance | Insurer, online or by mail |
| You truly have no employees | Signed exemption | You |
Five certificate mistakes CSLB lists
CSLB says manual certificates are processed by the date it receives a correct and acceptable one, so a returned certificate can cause a break in license standing. Its most common reasons for returning them:
- Incorrect business name
- Incorrect insurance company name
- Incorrect policy number
- CSLB not listed as certificate holder
- Invalid signature from the authorized representative
The certificate also needs your license number. Ask your agent to check these before it goes in. Insurers licensed to write workers' comp in California can also file through CSLB's online form, which updates the record automatically.
When the exemption is not an option
You cannot file an exemption if any of these apply:
- You employ anyone in a manner subject to California workers' comp laws.
- An RME qualifies your license.
- You hold C-8 Concrete, C-20 HVAC, C-22 Asbestos Abatement, C-39 Roofing, or C-61/D-49 Tree Service.
If you file an exemption and later hire someone, it stops being valid, and CSLB must receive proof of coverage within 90 days of the hire. More on this in workers' comp exemption mistakes.
Stop Orders
CSLB can order you to immediately stop using employee labor if you have no coverage for your employees. It stays in place until you have insurance, CSLB has verified the proof, and CSLB lifts the order. Not complying is a misdemeanor. You can request a hearing in writing within 20 days of receiving the order.
What is changing
SB 291 increased penalties for workers' comp violations starting in 2026 and directs CSLB to build a process for verifying exemption eligibility. Under SB 1455, the requirement for all licensees to carry workers' comp is set for January 1, 2028. If you rely on the exemption, plan for a policy now.
What it costs
CSLB's suspension page lists no fee to clear a workers' comp suspension. You pay your insurer's premium. Before you take new work, read what the law says about working while suspended.
